These Terms of Use ("Terms") govern your access to and use of Berimbolo, including the mobile app and website (the "Service"). By using the Service, you agree to these Terms.

1. Contracting Entity

These Terms are between you and TwoMindsLab ("we", "us", or "our").

2. What Berimbolo Is

Berimbolo is a local-first Brazilian Jiu-Jitsu training journal and training support app.

In this version, your training journal, saved videos, profile details, settings, and preferences are stored on your device. This version does not create a Berimbolo cloud account, does not sync your training data to a Berimbolo backend, does not use payment services, does not show ads, and does not send your journal content to AI providers.

3. Eligibility

You may use the Service only if you can legally agree to these Terms and you are 18 years old or older. If you are under 18, do not use the Service.

4. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial use.

5. Network Usage

This local-first version may use internet requests for:

  • optional usage analytics and crash diagnostics telemetry;
  • public YouTube, Instagram, and related CDN requests when you save or view supported video URLs;
  • opening website, legal, and support links.

6. Layered Privacy Notice

Berimbolo may show privacy information in layers, including short in-app summaries and just-in-time notices, together with the full Privacy Policy.

The short notices are provided for clarity and usability. Full details about data handling are described in the Privacy Policy.

7. GDPR and Privacy Rights

If you are in the EEA or UK, privacy rights under GDPR or UK GDPR are described in our Privacy Policy, including legal bases for processing and how to exercise data rights.

8. Health Disclaimer

Berimbolo is a journaling and training-support tool only. It does not provide medical advice, diagnosis, treatment, physiotherapy advice, injury-prevention advice, or professional coaching advice.

Brazilian Jiu-Jitsu and physical training involve risk of injury. You are responsible for deciding whether and how to train. Stop training and seek qualified medical advice if you feel pain, injury symptoms, dizziness, or other health concerns. Do not rely on the Service as a substitute for a doctor, physiotherapist, coach, or other qualified professional.

9. Acceptable Use

You must not:

  • use the Service in violation of law;
  • attempt to disrupt, abuse, or reverse engineer the Service beyond legal allowances;
  • enter malicious, unlawful, abusive, defamatory, or harmful content;
  • infringe rights of others;
  • enter personal data about other people unless you have the right to do so.

10. User Content

You retain ownership of the content you create in the app.

You are responsible for the training notes, profile details, saved videos, and other content you enter. We do not claim ownership of that content.

11. Data Management

You can remove locally stored app data by editing or deleting content, clearing app data, or uninstalling the app. If export or import features are enabled in your build, you are responsible for keeping exported files and passphrases safe.

12. Paid Features

This version does not offer paid subscriptions, in-app purchases, or paid digital goods. Some product areas may refer to feature limits or future premium functionality, but no paid purchase is currently available unless it is clearly shown through the App Store or Google Play purchase flow.

13. Intellectual Property

The Service, software, and branding are owned by or licensed to us and protected by law.

14. Availability and Warranty

The Service is provided "as is" and "as available". We do not guarantee uninterrupted or error-free operation.

15. Limitation of Liability

To the maximum extent allowed by law, we are not liable for indirect or consequential damages. Nothing in these Terms excludes liability that cannot be excluded by law.

16. Termination

You may stop using the Service at any time. We may suspend or discontinue the Service or parts of it if needed for legal, security, operational, or product reasons.

17. Changes to Service or Terms

We may update the Service and these Terms from time to time. The latest Terms will be published on this page. If changes are material, we may show an in-app notice or ask you to accept the updated Terms before continuing.

18. Governing Law

These Terms are governed by the laws of Ireland, subject to mandatory consumer rights that may apply in your jurisdiction.
